The immigration issues being debated in this country have now focused the United States government on the issue of enforcement operations designed to ensure that America’s employers fully comply with the provisions of the Immigration and Nationality Act (INA) and related statutes that govern the employment of foreign-born workers. These laws are complex and require an employer to properly execute all required actions before employing such workers, and to ensure compliance with the ever-changing laws and applicable regulations while continuing to employ foreign-born employee personnel. Failure to adhere to such requirements not only places an employer in jeopardy of losing much needed employees, but subjects the employer to possible civil as well as criminal penalties.
